In a victory for transparency and free speech, the D.C. Circuit Court of Appeals has unanimously ruled in X’s favor to limit the U.S. government’s ability to issue gag orders. These gag orders prevent X from notifying the public when it receives government search warrants and subpoenas.
Last year, X received a subpoena from the federal government demanding the personal information of two former FBI agents, Kyle Seraphin and Garrett O’Doyle. This was accompanied by a gag order requiring X to keep the subpoena secret. Seraphin and O’Doyle were whistleblowers who had disclosed to Congress that the FBI was improperly targeting certain politically disfavored groups.
Following their whistleblowing activities, Seraphin and O’Doyle were fired from their jobs and subject to a criminal investigation, suggesting retaliation by the government. Yet when X wanted to transparently disclose the government’s subpoena to the public, it could not do so because the government had obtained a gag order.
X challenged the gag order in court, arguing that it violated federal statutes and the First Amendment. The D.C. Circuit Court of Appeals has now vindicated X’s challenge, ruling that the gag order exceeded the government’s authority. X welcomes the ruling, which will help ensure transparency and accountability in the U.S. government’s efforts to investigate its citizens.

French authorities have launched a politically-motivated criminal investigation into X over the alleged manipulation of its algorithm and alleged “fraudulent data extraction.” X categorically denies these allegations.
This investigation, instigated by French politician Eric Bothorel, egregiously undermines X’s fundamental right to due process and threatens our users’ rights to privacy and free speech. Mr Bothorel has accused X of manipulating its algorithm for “foreign interference” purposes, an allegation which is completely false.
French authorities have requested access to X’s recommendation algorithm and real-time data about all user posts on the platform in order for several “experts” to analyze the data and purportedly “uncover the truth” about the operation of the X platform. One of those “experts” is David Chavalarias, who spearheads the “Escape X” campaign. Formerly known as “HelloQuitteX”, the campaign is dedicated to encouraging X users to leave the platform. A second “expert,” Maziyar Panahi, has previously participated in research projects with David Chavalarias that demonstrate open hostility towards X.
The involvement of these individuals raises serious concerns about the impartiality, fairness, and political motivations of the investigation, to put it charitably. A predetermined outcome is not a fair one. What’s more, French authorities have classified X as an “organized gang” for the purpose of the investigation. This characterization, which is usually reserved for drug cartels or mafia groups, enables the French police to deploy extensive investigative powers under French law, including wiretapping the personal devices of X employees.
X remains in the dark as to the specific allegations made against the platform. However, based on what we know so far, X believes that this investigation is distorting French law in order to serve a political agenda and, ultimately, restrict free speech.
For these reasons, X has not acceded to the French authorities’ demands, as we have a legal right to do. This is not a decision that X takes lightly. However, in this case, the facts speak for themselves.
X is committed to defending its fundamental rights, protecting user data and resisting political censorship.

Update on where has @grok been & what happened on July 8th.
First off, we deeply apologize for the horrific behavior that many experienced.
Our intent for @grok is to provide helpful and truthful responses to users. After careful investigation, we discovered the root cause was an update to a code path upstream of the @grok bot. This is independent of the underlying language model that powers @grok.
The update was active for 16 hrs, in which deprecated code made @grok susceptible to existing X user posts; including when such posts contained extremist views.
We have removed that deprecated code and refactored the entire system to prevent further abuse. The new system prompt for the @grok bot will be published to our public github repo.
We thank all of the X users who provided feedback to identify the abuse of @grok functionality, helping us advance our mission of developing helpful and truth-seeking artificial intelligence.

Since being made aware of the content, xAI has taken action to ban hate speech before Grok posts on X. xAI is training only truth-seeking and thanks to the millions of users on X, we are able to quickly identify and update the model where training could be improved.

Today, @X filed a First Amendment lawsuit against a New York law, NY S895B. NY S895B is a new social media regulation that is a carbon copy of a California law, CA AB 587, that X successfully challenged in court under the First Amendment last year. The Ninth Circuit Court of Appeals ruled the relevant portion of that law unconstitutional.
Undeterred, New York’s government passed its own version of the unconstitutional California law, in order to pressure social media platforms to “eliminate” certain speech the government doesn’t like. As with AB 587, X is the only platform fighting for its users by challenging the law, and we are confident we will prevail in this case as well. X will always fight for your right to express yourselves freely.
